Betway – The Gaming Contract (Terms and Conditions) These Terms and Conditions apply to you, and are binding upon you, if you Participate at https://www.betway.pt By Participating, you agree that you have read and understood these Terms and Conditions and you acknowledge that these Terms and Conditions shall apply to you. If you do not agree to any of these Terms and Conditions, you should immediately stop using the Software and remove the Software from your computer / laptop / mobile device.

By marking the box labelled “I am of legal age to gamble and I accept the Terms and Conditions and Verification Policy” as part of the registration process you are bound by these Terms and Conditions, our Privacy Policy, promotion - or competition - or specific terms and conditions, and other rules and policies relevant to your Participation and in each case as such may be notified to you and updated from time to time (all such rules and policies collectively referred to hereinafter as the “Rules”).

You are bound by the Rules in any event if you use the Service or the Software, including, but not limited to, initiating or making a deposit through the Service or submitting your deposit details to us.

In these Terms and Conditions: “Betway” means the brand and all products offered ‘Online’ (accessed via a computer or laptop) and on ‘Mobile’ (accessed via a mobile phone or tablet) by the Operator via the Website “Closed Account Customer” means a person who’s registered account has been closed, de-registered or excluded by either us or you; “Customer/s” mean(s) a Registered Customer or a Closed Account Customer; “Customer Funds” means the aggregate value of funds held by the Operator to the credit of Customers including, without limitation: a) cleared funds deposited at the Website by Customers to provide stakes in, or to meet participation fees in respect of, future gambling; b) winnings or prizes which the Customer has chosen to leave on deposit with the Operator or for which the Operator has yet to account to the Customer; and c) any crystallised, but as yet, unpaid loyalty scheme or other bonuses. “Gambling Authority” means the Gambling Regulation and Inspection Service (Serviço de Regulação e Inspeção de Jogos) “Games” means any and all games / offerings by the Operator “Intellectual Property” means trademarks and trade names, whether registered or not, including trade mark applications and registered trademarks, with the goodwill which attaches in such trade names and trademarks, domain names, getup, trade dress and trading style, including without limitation as presented in websites; domain name registrations and any variations thereof now and in the future; any copyright in the getup, trade dress or trading style, any right or license under copyright to use such getup, trade dress or trading style, any software code, architecture of software, look and feel of software, or any other intellectual property, owned by or licensed to us, in each case in any part of the world. “Operator” means GM Gaming Limited, holder of Portuguese license number [TBC] issued by the Gaming Authority “Participate” means any of the conduct described in 3.1 to 4.11 below, visiting Betway, playing any "Games" or using our "Software" in any manner whatsoever. “Registered Customer” means a person who has successfully registered an account with us in the manner as described in clause 3.2 “Service” means the availability to, and provision of, the Software that enables you to Participate. “Software” means any software owned by or licensed to us in order for you to Participate, or any downloadable/flash/mobile game versions of the software offered by the Operator. “we/us/our” means GM Gaming Limited together with (where context permits) its holding companies and associated companies. “Website” means https://www.betway.pt “You/Your” and also referred to as “Customer”, means any person who enters the Website and Participates in any “Games” provided by the Operator. 1. The Parties The Website is operated by GM Gaming Limited (C43029), a Maltese registered company whose registered address is Villa Seminia, 8, Sir Temi Zammit Avenue, Ta’Xbiex XBX1011, Malta. Betway is a brand licensed to the Operator and owned by Betway Limited (C39710), a Maltese registered company whose registered address is: 9 Empire Stadium Street, Gzira, GZR 1300, Malta. 2. Your Participation at Betway 2.1. Restrictions You may only participate at Betway if you are over 18 years of age and are a resident of Portugal It is illegal to play at Betway if you are under 18 years old. PERSONS IN BREACH OF SECTION 2.1 OR OTHERWISE IN BREACH OF THESE TERMS WILL NOT BE ENTITLED TO COLLECT ANY WINNINGS. FURTHERMORE, ANY PERSON WHO IS KNOWINGLY IN BREACH OF SECTION 2.1 MAY BE COMMITTING FRAUD AND MAY BE SUBJECT TO CRIMINAL PROSECUTION. 2.2. Identification Documentation To participate at Betway, you are required to enter your personal details during the account registration process. Personal details include, but are not limited to:Full Name, Address, Date of Birth, Nationality, ID/Passport number, Tax Identification number, Occupation, e-mail address and payment account information. If the Operator is unable to verify your identity automatically, you will be required to send in valid identification documents proving your age and address. Acceptable identification documentation includes, but is not limited to: a) copy of a valid photographic identification document, such as a Passport or Driver’s License containing your date of birth; and b) copy of a recent utility bill confirming residence, such as an electricity bill, telephone bill etc. (important: the utility bill must not be older than 3 months) c) copy of a recent credit / debit / bank account statement (note: the account statement must relate to a financial method used and must not be older than 3 months). 2.3. Identification and Age Verification You may only become a Registered Customer once your identity has been verified and after We have confirmed there are no restrictions preventing you from registering with Betway. You hereby authorise us and our designated agents, as and when we require, to confirm your identity and to clarify your right to use the money that you have wagered at Betway. 2.4. Risk You accept that Participation at Betway is at your sole option, discretion and risk. Furthermore, you agree that Participation at Betway is for your own personal entertainment and non-professional use and, in doing so, are acting on your own behalf. 2.5. Acceptable Use You represent, warrant and agree that you will comply with all applicable laws, statutes and regulations in relation to your use of the Software and Service. We are not responsible for any illegal or unauthorised use of the Software or the Service by you. By accepting these Terms and Conditions you agree to assist us, to the extent that you are able, with the compliance with applicable laws and regulations. 3. Your Account 3.1. Single Account You may only register and operate a single account. If you are found to be holding more than one account, all such accounts will be immediately closed. 3.2. Accuracy You are required to keep your registration details up to date at all times. If you change your address, e-mail, phone number or any other contact or personal information, please contact Customer Service / support@betway.pt in order to update your account information. 3.3. Password The account registration process requires you to choose your own user name and password combination. You must keep this information secret. Any actions carried out through your account will stand if your user name and password have been entered correctly. 3.4. Verification of Bank Details If you use a credit/debit card and/or a financial/bank account for transactions at Betway, the account/cardholder’s name MUST be the same as the name you used when registering a Betway account. Should the name you registered on the Betway account and the name that appears on your credit/debit card and/or financial/bank account differ in any way, your account will be temporarily suspended . Should your account be temporarily suspended, we recommend you contact Customer Service / support@betway.pt for details regarding our verification process. 3.5. No liability The Operator shall accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with your Participation; including and without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person’s misuse of the Software, its content or any errors or omissions in the Website’s content. 3.6. Dormant Accounts a) Dormant Accounts According to the Regulation 836/2015, any Account that remains uninterrupted for a period of two (2) years must be suspended. Also in accordance with the Regulations, the Account must be cancelled when an uninterrupted period of two (2) years has elapsed without access from the date of suspension. After the cancellation of the account, the Operator will order the transfer of any funds deposited in the player account to the payment account within 48H. Should this operation fail for any reason, the Operator shall attempt to contact you with a view to return any remaining funds. If you wish to reactivate a suspended account, you may be required to provide certain documentation as required by the Operator. 3.7. Inter-Account Transfers The transfer of funds between individual accounts is strictly prohibited. 3.8. Interest Any monies held in your account shall not attract interest. 3.9. Account Temporary Suspension The Operator reserves the right to temporarily suspend your account, pending an investigation, should you be suspected of: a) having unlawfully obtained winnings b) having violated conditions set out in the terms and conditions governing the account You will be notified of our decision via e-mail and a documented copy of the decision may be sent to the Gaming Authority. During this period, it will not be possible for you to unlock the account. 3.10. Account Closure and Temporary Suspension If you wish to close your account by terminating your gaming contract, please contact Customer Service for assistance. Our Cooling-Off and Self-Exclusion procedures are summarised at clause 7.2 of these Terms and Conditions and are set out in detail in section 3.2 of our Responsible Gaming Policy. 3.11. Refusal to Register, Deregistration, Exclusion & Suspension If we become aware that a Customer is underage, we will, except where there are grounds to believe that a fraud has been perpetrated: a) Suspend the Customer’s account immediately; b) Void all wagers that have taken place c) Refund the value of all deposits net of withdrawals; and d) Close the Customer’s account. Irregular Play is deemed when we detect unnatural player betting patterns. Irregular play includes, but is not limited to, any one or more of the following types of play: a) Placing single bets equal to or in excess of 15% of the value of the bonus before the wagering requirements for that bonus have been met. b) Using the double-up feature to increase bet values. c) Placing high-value bets with the single intention of increasing your balance, thereafter proceeding to place bets of less than half of the prior bet value, while reasonably not decreasing your bankroll, in order to meet bonus wagering requirements. d) Even money bets on Sic Bo, craps, baccarat, Wheel of Riches and roulette. e) Employing a strategy by which high-value bets are placed on any game with play-through contribution weightings less than 30% (any table games, card games, video poker, etc.) and then proceeding to place bets of less than half of the prior average bet value while changing game type to higher-weighted games (slots, casual games, scratch cards, etc). Any irregular play will result in immediate disqualification from a bonus. Any repeat offence of irregular play may result in a temporary suspension from the Website, pending an investigation. 3.12. Credit Participation on credit is prohibited at Betway. 4. Payment Details / Deposits / Withdrawals 4.1. Identification Checks We must successfully receive and verify your identification documents, either via internal means or a third party, before you can withdraw from your account. 4.2. Credit Checks The Operator reserves the right to run credit checks on all cardholders with third party credit agencies on the basis of the information provided on registration. 4.3. Records It is the cardholder’s responsibility to retain copies of transaction records and Website policies and rules. 4.4. Deposits When creating an Account, you must make a minimum deposit of 10 EUR before you start to bet or play. 4.5. Withdrawals In accordance with the Operator’s Withdrawal Policy, the minimum withdrawal amount is 10 EUR and all withdrawals will be processed back to the same payment method used to make a deposit on the account. As outlined in clause 3.4, if a financial account and/or credit/debit card has been used to deposit funds, the name registered on the account must correspond to the name registered on the account/card. In the case of a request to pay funds via Direct Bank Transfer (DBT), the acquiring bank account must be held in the same name as used during registration. a) A bonus balance cannot be withdrawn from any account b) Where the payment of a bonus under the terms of any promotion is dependent on you making a deposit into your cash balance and you withdraw all or part of the deposit before the bonus is paid into your bonus balance, you will forfeit the bonus in question and any winnings won using the bonus. c) If your requested withdrawal amount (singular or cumulative lifetime withdrawals) is five times or more than your lifetime deposits, the withdrawal amount will be released in lots of up to 5,000 credits per week. The remaining amount will remain in your account until you are eligible for a further withdrawal. Any deposits made after the date of withdrawal will not be included in this calculation. This clause will be applied at the discretion of the Operator. Wins from progressive games are exempt from this clause. d) Once you have met the wagering requirements, all subsequent deposits will be added to your cash balance. If, prior to meeting the full wagering requirements, your bonus balance drops below €1 (or currency equivalent), and provided there are no bets in play at the time, then your wagering requirements will be considered to have been met. For example, bets in play may include any unplayed Free Spins waiting on a slot game, a bet waiting to end on a blackjack table or an incomplete token game (a token game is one in which a player needs to earn tokens or tickets to complete an achievement). Withdrawal Limits on Free Promotional Offers The Operator reserves the right to limit withdrawals from any Free Bonus / Free Casino Spins added to a Customer’s account up to the value of /€50. Free Bonus / Free Casino Spins cannot be exchanged for cash credits. 5.2. Right to Rescind We reserve the right to withdraw any promotion, competition, bonus or special offer at any time. In addition, we reserve the right to limit withdrawals from any Free Bonus / Free Casino Spins as outlined in clause 5.6. If you do not want a promotion bonus that has been deposited into your bonus balance by the Operator, you may request to have that promotion bonus removed from your bonus balance. Such a request can be made by email or telephone. If any wagering of a promotion bonus has taken place, then that promotion bonus may not be removed from your account until the wagering requirements associated with that promotion bonus have been met. The Sports Welcome Offer will expire and be voided after 60 days of it being credited, regardless of any wagering achieved or outstanding. You hereby authorize the Operator, or parties designated by the Operator, to process your personal data in accordance with the Privacy Policy. 7. Responsible Gaming 7.1. Policy We are committed to offering our Customers a fun and friendly online gaming experience, whilst also recognising that gambling can cause problems for a minority of individuals. For this reason, we actively support responsible gaming and encourage Customers to make use of a variety of responsible gaming features so as to better manage their account. Take a Break and Self - Exclusion You may, at any time, request a Take a Break period (temporary suspension) or Self-Exclusion from Betway. To view the various Take a Break and Self-Exclusion options available, please refer to section 3.2 of our Responsible Gaming Policy. Should you opt for self-exclusion in the manner contemplated in clause 7.2 above, you will NOT be able to use your Account for the duration of the self-exclusion period. In the interests of promoting responsible gambling, at your request, we will block you from accessing your account for a minimum of three (3) months. Any undetermined bets or wagers at the time of your self-exclusion will be settled in the normal way, according to normal timescales and, if subsequently applicable, winnings paid to you. Any Account blocks due to self-exclusion cannot be undone during the agree self-exclusion period. 8. Player Protection 8.1. No warranties The Service and the Software are provided on a “as is” basis and to the fullest extent permitted by law, we make no warranty or representation, whether express or implied, in relation to the satisfactory quality, fitness for purpose, completeness or accuracy of the Service or the Software. 10.2. Malfunctions We shall not be liable for computer malfunctions, failure of telecommunications service or Internet connections nor attempts by you to Participate in games by methods, means or ways not intended by us. In the event of a malfunction in a Game, Service or any of the related systems, or due to any other error, all wagers placed during such period are void and will be refunded. Funds obtained from a malfunctioning Game or Service shall be considered void, as well as any subsequent game rounds or Services with said funds, regardless of what Games or Services are played using such funds. Viruses Although we shall take all reasonable measures to ensure that the Software and files are free from computer viruses we cannot and do not guarantee that the Software and files are free of such problems. It is your responsibility to protect your systems and have in place the ability to reinstall any data or programs lost due to a virus. 10.5. Service Suspension We may temporarily suspend the whole or any part of the Service for any reason when previously and duly authorized by the Gambling Authority. In such case, we will give you as much notice as is reasonably practicable of such suspension. We will restore the Service, as soon as is reasonably practicable, after such temporary suspension. 10.6. Voided Bets In the event of a system malfunction, all unconfirmed bets are void. We are not liable to you for any loss that you may incur as a result of such suspension or delay. 10.7. Customer Complaints Customer complaints/claims of any nature must be submitted within 3 months of the issue occurring. In addition, the written communication must contain the following information: a) your username/account number b) your registered First Name and Surname c) a detailed explanation of the complaint/claim d) specific dates and times associated with the complaint/claim (if applicable) Note: failure to submit written communication as outlined above may result in a delay and our ability to identify and respond to your complaint/claim in a timely manner. Upon receipt, best efforts will be made to resolve any reported matter promptly and, at a maximum, within one month. Should you ever suspect that a Customer is colluding with another Customer or cheating in any way, please notify us via the means of communication listed in the above Customer Complaints procedure. 10.8. Change We reserve the right to suspend, modify or remove or add content to the Website or the Software at our sole discretion. We shall not be liable to you for any loss suffered as a result of any changes made or for any modification or suspension of or discontinuance of the Software or Services and you shall have no claims against us in such regard. 10.9. Connectivity You (the Player) are solely responsible for any telecommunications devices, networks, GPRS, Internet access services and other consents and permissions required in connection with your use of the Website. 10.10. Network Operator and Other Charges You are solely responsible for any connection, use or other charges levied by your network operator when you register to play the Games, download the Software, place bets or communicate with us. These charges shall form no part of any bets placed. 11. Indemnity and Limitation of Liability 11.1. Limitation of Liability The total liability of our directors, officers, employees, shareholders, agents and affiliates, our ultimate parent and parent companies and any of our subsidiaries to you in contract, tort, negligence or otherwise, for any loss or damage howsoever arising from any cause, whether direct or indirect, or for any amounts (even where we have been notified by you of the possibility of such loss or damage) shall not exceed the value of the bets and/or wagers you placed via your account in respect of the relevant bet/wager or product that gave rise to the relevant liability. 11.3. Links We shall not be liable in contract, tort, negligence, or otherwise, for any loss or damage arising from or in any way connected with Your use of any link contained on the Website. We are not responsible for the content contained on any Internet site linked to from the Websites or via the Services. 11.4. Negligence Nothing in these Terms and Conditions will operate so as to exclude any liability of the company for fraud, death or personal injury that is caused by the company’s negligence. 12. Availability of Offers 12.1. Eligibility If a Customer breaches the terms of any promotion or promotional offer, the Operator reserves the right to hold back or reclaim any bonusor Free Bets awarded or to void any winnings arising from the betting of the proceeds if such bonus, cash or Free Bets. All offers are limited to one person, family household address, e-mail address, telephone number, same payment account number (e.g. debit or credit card, etc.) and shared computer, e.g. school, public library or workplace. All Betway offers are intended for recreational customers and the Operator may in our sole discretion, limit the eligibility of customers to participate in any given promotion. We reserve the right to withdraw the availability of any offer or all offers to any Customer. 13. Support and Governing Law 13.1. Governing Law and Jurisdiction These Terms and Conditions are governed by, and interpreted in accordance with, the laws of Portugal and You irrevocably submit to the exclusive jurisdiction of the courts of Portugal to settle any disputes (including claims for set off and counterclaims) which may arise in connection with the creation, validity, effect, interpretation or performance of, or the legal relationships established by or otherwise arising in connection with these Terms and Conditions. 14. Financial Institution 14.1. No Interest The Operator is not a financial institution and thus any deposits made into your account are not due any interest payments on the deposit(s) whatsoever. 14.2. No Arbitrage You are strictly prohibited from utilising Betway and it systems to facilitate arbitrage through Currency Exchange transactions. Where we deem that you have deliberately used the systems for financial gain through arbitrage, any gains will be forfeited and deducted from your balance without warning or notification. 14.4. Anti-Money Laundering Customers are strictly prohibited from using Betway and its systems to facilitate any type of illegal money transfer. You must not use the Website for any unlawful or fraudulent activity or prohibited transaction (including money laundering) under the laws of any jurisdiction that applies to you. If we suspect that you may be engaging in, or have engaged in fraudulent, unlawful or improper activity, including, money laundering activities or any conduct which violates these Terms and Conditions, your account will temporarily be suspended, pending an investigation. In addition the Operator shall be entitled to inform the relevant authorities, other online service providers, banks, credit card companies, electronic payment providers or other financial institution of your identity and of any suspected unlawful, fraudulent or improper activity. You will cooperate fully with any investigation into such activity. The Customer must not use or consider their Customer account as a bank account. In cases where deposits or withdrawals are made without the existence of bets, or when these actions are carried out using very small proportions of the initial deposits, the Operator reserves the right to request explanations before transferring the amount in question, without prejudice to the situation report to the regulatory body and other competent entities, for the purpose of ascertaining the framework in the possible practice of crimes of money laundering and terrorist financing and the application of the measures in this respect provided for in Regulation 836/2015 of the Rules and Procedures on Registration and Player Account and in these Terms and Conditions. 15. Termination of Account Any balance in your account at the time of such a cancellation will be credited to your credit/debit card or financial account. Betway is for sole use on an individual basis and for personal entertainment only. g) If the Operator has received a “charge back” and/or a "return" notification via a deposit mechanism used on your account; h) If you are found colluding, cheating, money laundering or undertaking any kind of fraudulent activity; or i) If it is determined by us that you have employed or made use of a system (including machines, computers, software or other automated systems such as bots etc) designed specifically to defeat the gaming system. If we have reasonable grounds to believe that You have participated in any of the activities set out in clauses (a) – (i) above then (in addition to any temporary suspension of Your account enacted), we reserve the right to withhold all or part of the balance and/or recover from Your account deposits, pay outs, bonuses, winnings that are attributable to any of the practices contemplated in clauses (a) – (i) above.
